Terms of Service
1. Provider and scope
These terms govern the use of the website mindhafen.orkaid.de and of the MindHafen YouTube Copilot application (together, the “Service”). The Service is provided by Mihai-Adrian Mateescu (ORKAID), Bahnhofstraße 65b, 21218 Seevetal, Germany, kontakt@orkaid.de. Full provider information is in the Impressum.
2. Availability
The website is freely accessible for information. The application is in private development, is not publicly available and is not offered for sale. It may only be used by persons the provider has expressly authorized. There is no entitlement to access, and features may change, be suspended or be discontinued at any time.
3. YouTube and Google
The application uses YouTube API Services. By connecting a YouTube account to the application, you agree to be bound by the YouTube Terms of Service. Google processes data in accordance with the Google Privacy Policy.
MindHafen YouTube Copilot is an independent project and is not affiliated with, sponsored by or endorsed by Google LLC or YouTube. You can revoke the application's access at any time through the Google security settings.
4. Use of the application
- Connect only YouTube channels you own or are authorized to manage.
- Do not use the Service to violate the YouTube Terms of Service, the YouTube Community Guidelines, applicable law or the rights of others.
- Do not attempt to circumvent technical restrictions, quotas or security measures of the Service or of YouTube.
5. AI-assisted output
The application can generate insights, drafts and suggestions with the help of AI models. Such output may be incomplete or wrong, is provided as a draft for human review, and is not professional advice. You remain responsible for any decision you take and any change you make to your channel or content, including changes applied through the application after your explicit confirmation.
6. Data protection
How personal data and Google user data are processed is described in the Privacy Policy.
7. Intellectual property
The Service, its software, texts and design are protected by copyright. Your channel data and content remain yours. YouTube and related marks are trademarks of Google LLC.
8. Liability
The Service is provided free of charge and without any warranty of availability or fitness for a particular purpose, to the extent permitted by law. The provider is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, the provider is liable only for breach of an essential obligation whose fulfilment makes proper use of the Service possible and on which users may regularly rely, limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.
9. Changes
These terms may be updated, in particular before the application is made available to anyone other than its operator. The effective date above shows the current version.
10. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not remove the protection of mandatory provisions of the law of the country in which they have their habitual residence.
